Beyond the obvious benefits, another to consider is tax breaks. However, when it comes to taking advantage of these tax credits from Uncle Sam, the requirements to do so can be confusing. In this episode, I make it a little easier. I review how the tax credits work and some things to keep in mind when purchasing a Tesla or any other electric vehicle. First and foremost, it's important to understand that the tax breaks for purchasing an EV are tax credits, not discounts towards the purchase of your vehicle. It's also important to understand how your income impacts your tax credit. Lastly, the number of units sold by vehicle manufacturers also play a role in electric vehicle owners' tax credit eligibility amounts. Please note, these federal tax credits are available to US Tesla owners only. Now, let's talk dollar amounts. According to IRS.gov, "The total amount of the credit allowed for a vehicle is limited to $7,500."and, in the US, "the credit begins to phase out for a manufacturer's vehicles when at least 200,000 qualifying vehicles have been sold." And, every two quarters, after the phase out begins, that $7500 is reduced by 50%. Also, super important to note, the credit does not take effect until you take ownership of the vehicle. So, when you reserve and bring your Tesla home will likely impact your tax break. Considering all the above, if Tesla hits 200k units sold in October 2017, the credit will be $7500, and that will last through January 2018. From Q2 - Q3 of 2018, the credit will drop to $3,750. In October 2018 - March of 2019, the credit reduces to $1,875. Based on these projections and considerations, come April 2019, there will be no available tax credit for purchasing a Tesla or any other electric vehicle. While I'm obviously a Tesla advocate, there are other electric vehicles that are worth considering - these include the Chevy Bolt as well as the next generations of the Nissan Leaf and the BMW i5. In 2018, there will also be a flood of new options, including higher end EVs from Jaguar and Volkswagen. Whatever electric vehicle option you choose, you'll not only be saving with tax credits but by helping the planet and saving at the pump. And, when considering which electric vehicle to go with, be sure you have all the facts. For all B2B sales, GSTIN of buyer will be required (not under GSTR 3B, but the same will be required later) • Sales made to SEZ or exports made outside India without levying of GST are called Zero rated sales • Sales of commodities which are chargeable at 0% GST or are exempt from GST are called Nil rated and exempted sales respectively. • Commodities like petrol, diesel, liquor, etc are not chargeable under GST. Such goods are called Non GST goods Please bifurcate your sales based on above understanding Purchases / Expenses: Purchases and expenses will have same categories as sales above. Besides that, additional points which need to be taken care are as follows: • Input Tax Credit (ITC) will be available on almost all purchase / expenses made for the business. Following conditions are applicable to claim the ITC: o Seller should have issued Original invoice with particulars prescribed under the GST law. o The invoice should have your business’ name, address and GSTIN o Seller has to show the invoice in his sales return (this is the most important condition) o Seller has to pay the tax as per the invoice • ITC is not available on following expenses: o Car rental o Food expenses o Hotel stay in state other than the state in which you are registered Please note that this is not an exhaustive list. These are the main expenses which will be not available as credit. We will review the credit and will let you know in case any other expenses are incurred which are not allowed for claiming ITC • Reverse Charge Mechanism (RCM) is applicable under GST. As per the concept of RCM, the buyer will be liable to discharge the liability of GST instead of seller. RCM will be applicable on following purchases / expenses: o Import of goods: At the time of clearance of goods from port, Basic Customs Duty (BCD) as well as IGST will be payable to the Customs authority. This IGST will be available as credit, provided bill of entry has the GSTIN of the importer o Import of services: On import of services within India, the importer will have to discharge GST and then claim ITC, if the expenses are eligible for ITC o Purchase from Unregistered dealer (URD): If the purchases (of goods or services) are made from URD, the buyer will have to discharge GST on behalf of seller to the government. ITC may be available later, if expenses are eligible for ITC. There is an exemption on payment of tax if the expenses / purchases from URD is less than Rs. 5000 per day. Please note the exemption is only for this category and up to Rs. 5000 per day. In case the expenses exceed Rs. 5000 per day, tax is payable on entire amount. o Specific expenses: Apart from the above, specific expenses, like Transport by road, legal expenses, etc are chargeable to RCM. Under GST, a registered dealer is required to file three returns every month and one annual return. So, in total 37 returns have to be filed every year. Since filling up these complex forms require a great amount of time and understanding, the government has postponed the filing of GSTR 1,2 & 3 for July and August, 2017. In the place of these monthly returns, GSTR 3B has been introduced. Deadlines for July and August GST Returns are as follows: Forms For July 2017 For August 2017 GSTR 3B 20th August 20th September GSTR 1 5th September 20th September GSTR 2 10th September 25th September GSTR 3 15th September 30th September There will be no late fee or penalty levied for the months of July and August. Eventually, this GSTR-3 will be matched against GSTR-3B and any difference will be refunded or will require payment as the case may be. It purchased packing material for packing rice, without payment of sales tax on the strength of its registration by furnishing declarations in for ST-1/ST-49/Form-H. 3. After the coming into force of the VAT Act, w.e.f. 1.4.2005, packing material was being purchased by appellant on payment of VAT and input tax was being claimed as a refund. 4. Subsequently, Commissioner, VAT, gave a ruling that packing material can be purchased against Form-H also. 5. Appellant claimed input tax credit and asked for refund of input tax on the ground that packing material was used to pack rice which was exported. 6. VATO rejected the claim of the appellant. 7. Joint Commissioner and Tribunal, VAT, rejected appellant’s appeal. 8. High Court, on appeal, held that VAT authorities were not justified in holding that appellant was not entitled to tax credit in respect of turnover of purchases of packing material. 9. It’s one of the best selling mid-size premium sedans in the US. It’s made of aluminum & steel, scoring 5 stars in every safety category. It has the lowest probability of injury by any car ever tested by the NHTSA. It has many unique design elements including an all glass roof, minimalist interior with a 15” center touch screen that controls almost everything, and an exterior with sleek aesthetics that focuses on maximizing aerodynamics. Pricing & Options There are 3 current configurations: Rear Wheel Drive starting at $46,000, Dual Motor AWD starting at $53,000, and Dual Motor Performance starting at $64,000. The Long Range battery on both dual motor options has an estimated range of 310 miles. Mid range battery has an estimated range of 260 miles. The future 2019 base Model 3 will be RWD with a standard range battery of 220 miles for $35,000. The single motor & non-performance dual motor options come standard with 18” Aero wheels (19” Sport wheels upgrade is $1500). All Dual Motor Performance Model 3s come with 20” performance wheels. All Model 3 configurations come with black premium interior package but you can upgrade to white for $1,000. Any paint color besides black will cost at least an additional $1,500. Enhanced AutoPilot is Tesla’s partial self driving feature & costs $5000 when ordering or you can order it after delivery for $7000. All Model 3 purchases require a $1200 destination fee. I think Enhanced AutoPilot is a must if you’re buying a Tesla. I use it every time I drive and get so much use out of it. If you’re getting a non performance Model 3, I’d stick with the Aero wheels because of the slight range efficiency improvement plus you can easily take them off and reveal a nice looking rim underneath. When it comes to choosing the battery & motor, I’d choose the non performance Dual Motor just because of the 300+ miles of range without having to spend extra money for the performance. The dual motor all wheel drive will handle great and it’s plenty fast for almost everyone. I think the 300 mile barrier for range is one of the biggest advantages of the long range Model 3 which is why I chose the Long Range for mine. Federal Tax Credit (Disclaimer: I’m not a tax professional and this is not tax advice. Always consult a professional). The tax credit is like a discount on how much federal income tax you owe for the year you take delivery of your Tesla. To get the full $7500 federal tax credit you must take delivery of your Model 3 before 2019 and you must owe at least that much in federal income taxes. If you owe less than $7500 in federal income tax and take delivery in 2018 you only get credit up to what you owe. If you take delivery during the first half of 2019 you’ll get a federal income tax credit of up to $3750, and if you take delivery in the last half of 2019 the federal tax credit is $1875. Bottom line: the sooner you order your Model 3, the better. Prep & Delivery $2500 down payment. Once VIN is assigned you can apply for loan Delivery estimated anywhere between 4-10 weeks depending on your location & configuration 30 miles per hour of charge with NEMA 14-50 (most popular) 44 miles per hour of charge with Tesla Wall Connector Driving & Charging Charging at home (check w/ electric company to see about off-peak hours or special rates for electric vehicles) Scheduled charging (I set mine at 80% limit for daily driving) Supercharging for road trips (10,000 supercharges worldwide, recharge 170 miles in 30 minutes) Plugshare & Chargepoint Reduced range when driving above 65 mph, accelerating quickly & often, cold weather Software & Touch screen OTA updates Driver profiles Climate control Navigation maps Tesla account online; see supercharger history Smartphone as key Maintenance & Care Comes with basic new vehicle warranty and battery warranty, specific to the type of battery you chose when configuring. 24/7 Tesla roadside assistance during warranty Conclusion #TeslaModel3 is a fantastic car, electric or not. One question that I get asked quite often, because it’s a really good question, is how the owner of a single-member LLC is supposed to pay him/herself. There are two possible answers to this question, depending on how the LLC is taxed. Unless the LLC elects otherwise, a single-member LLC is considered a “disregarded entity” and all of the income to the LLC is treated as income to the business owner, and is all subject to self-employment tax. So basically, the owner of a single-member LLC can pay himself however and whenever he wants, keeping in mind a few important considerations: 1. Make sure you are prepared to pay taxes. Since the LLC is a disregarded entity, if the business earns $100k but you only “pay” yourself $50k, you are still going to be responsible for paying all of the taxes, including self-employment taxes, on the full $100k. (For simplicity’s sake, I am pretending there are no deductions or anything.) So you need to set aside enough money to make sure you can cover your taxes. 2. The business has to remain adequately capitalized. This means that you need to keep enough money in the business to cover all your overhead, debts, bills, salary for employees, etc. You should also leave some extra “padding” for possibly building up your business, purchasing equipment, and whatever else you may decide to do with your business. In the books, any payments to yourself should be recorded as “Member Distribution” or “Member Withdrawal.” If the LLC elects to be taxed as an S Corporation, on the other hand, you have to be paid a “reasonable” salary. Self-employment taxes will only be paid on that salary rather than on the full amount of profit the business earns. Any money that the business owner takes above that reasonable salary is considered a dividend and won’t be subject to self-employment taxes. If your LLC is taxed as an S Corp, then the salary you earn can be part of your payroll, and any additional dividends will be separate from that. Whether or not you elect to have your LLC taxed as an S Corp and how to handle and record the money that you pay yourself is an important conversation that should be had with your accountant, bookkeeper, & attorney.
